GUTCALL Privacy Policy

This Privacy Policy explains how GUTCALL LLC, a New Jersey limited liability company ("GUTCALL," "we," "us," or "our"), collects, uses, discloses, and retains personal information in connection with gutcall.net, Request Access, the GUTCALL intelligence service, the GUTCALL Intelligence API, and related communications and tools (collectively, the "Service").
GUTCALL minimizes personal information and does not sell personal information or use it for cross-context behavioral advertising. Contact intelligence@gutcall.net with privacy questions or requests.
1. Scope
This Policy applies to:
- visitors to our public website;
- Request Access applicants and people who used an earlier launch-interest or waitlist form;
- approved clients, organization administrators, and holders of a GUTCALL credential;
- people who contact us for support, legal, privacy, safety, or business reasons;
- personal information that may appear in lawful public-source or licensed information analyzed by GUTCALL.
This Policy does not govern a third-party website, prediction-market venue, authentication provider, or data provider that publishes its own privacy policy. Their practices are governed by their policies.
2. Request Access and launch-interest information
The Request Access form collects:
- email address;
- name or professional handle;
- organization or affiliation, if you choose to provide it;
- your short response to "How do you expect to use GUTCALL?";
- submission time and basic security information associated with the request.
An earlier launch-interest or waitlist form may have collected only an email address and submission time.
Do not include passwords, private keys, government identifiers, financial-account details, health information, precise location, or other sensitive personal information in your application response.
Submitting a request does not create an account, subscription, trial, or right to access. We use the information to review the request, communicate about access, maintain application integrity, prevent abuse, and administer any resulting relationship.
3. Approved-client and credential information
If GUTCALL approves your application, we may process:
- email address and an internal client identifier;
- name, handle, organization, and role information you provide;
- entitlements, organization membership, and administrative roles;
- versions and timestamps showing acceptance or acknowledgement of legal terms;
- credential issuance, rotation, revocation, and use records;
- correspondence relating to your access.
GUTCALL does not operate public sign-up, and no self-service account can be created. A credential is issued to an approved person or organization and identifies the holder to GUTCALL for delivery and security purposes.
4. Delivery preferences
GUTCALL may record which maintained questions an approved client is entitled to receive, the delivery method agreed with that client, and the technical settings needed to serve them. The Service does not require, request, or store private wallet keys, venue account credentials, or trading positions.
5. Technical, security, and usage information
When you use the Service, we and our infrastructure providers may process:
- IP address;
- browser, device, operating-system, and language information;
- request path, timestamp, response status, and similar server logs;
- rate-limit counters, abuse indicators, and security events;
- application errors and diagnostic information;
- general feature interactions needed to operate, secure, and improve the Service.
IP-based rate limiting may cause an IP address or derived key to be sent to Upstash and held temporarily in rate-limit storage. Vercel and other hosting infrastructure may also process request and network logs as part of delivering the Service.
GUTCALL does not currently use Google Analytics, advertising pixels, cross-site advertising cookies, or third-party session-replay tools. If that changes, we will update this Policy and implement any required notice, consent, or opt-out controls before using them.
6. Communications and support
We process the content and metadata of communications you send to us, including Request Access correspondence, support requests, privacy requests, safety reports, corrections, legal notices, and feedback.
We may send:
- access-request and account messages;
- authentication and security messages;
- service, billing, legal, and operational notices;
- product updates or marketing messages where permitted.
You may opt out of marketing messages through the unsubscribe method in the message or by contacting us. You may still receive non-marketing messages needed to administer your request, account, security, subscription, or legal relationship.
7. Payment information
Request Access does not collect payment information. If you enter a paid arrangement under an Order Form, payment arrangements are agreed directly with GUTCALL or processed through an identified payment provider under its own privacy terms. GUTCALL does not operate self-service purchasing or an online payment portal.
GUTCALL may receive and retain transaction identifiers, client identifiers, billing contact details, Order Form details, invoices, tax records, payment status, and limited payment-method information such as brand and last four digits. GUTCALL does not store full payment-card numbers or security codes.
We will identify the payment provider and update this Policy or the Order Form before collecting payment if required.
8. Public-source and licensed intelligence information
GUTCALL observes events and conditions in the physical and digital world and connects evidence to prediction-market questions. In doing so, GUTCALL may process information from government records, public blockchains, prediction-market sources, public web sources, licensed datasets, and other lawfully accessed sources.
That information may concern organizations, public officials, public figures, market participants, public wallet activity, professional roles, public statements, travel or transportation conditions, commercial activity, and other observable events. Some information may constitute personal information even when it is public.
We process this information to research, verify, analyze, publish, correct, secure, and maintain GUTCALL intelligence. We apply source-rights, evidentiary, privacy, safety, and retention controls appropriate to the source and use. We do not treat public availability alone as permission for unrestricted collection or redistribution.
Contact intelligence@gutcall.net to report a material factual error, safety concern, or privacy concern involving GUTCALL intelligence.
9. How we use personal information
We use personal information to:
- receive, review, and administer Request Access submissions;
- communicate application decisions and access instructions;
- create, authenticate, support, and secure accounts;
- assign and enforce entitlements, organization roles, API limits, and customer terms;
- provide, personalize, synchronize, maintain, and improve the Service;
- deliver requested communications and respond to inquiries;
- process subscriptions, invoices, and payments if paid access is introduced;
- detect fraud, abuse, unauthorized access, scraping, and security incidents;
- enforce our Terms and protect GUTCALL, users, sources, and the public;
- conduct lawful intelligence research, verification, publication, and correction;
- comply with legal obligations and respond to lawful requests;
- establish, exercise, or defend legal claims;
- complete a merger, financing, reorganization, acquisition, or sale of assets.
10. Access review and automated processing
GUTCALL makes access decisions manually. We may use automated controls to detect spam, rate-limit requests, identify obvious abuse, or protect the application, but we do not use solely automated profiling to make an access decision that produces a legal or similarly significant effect.
Admission criteria and internal review methods may remain confidential. This does not limit any privacy rights you have under applicable law.
11. Cookies and local storage
The public pages of gutcall.net set no cookies and use no browser storage. There is nothing to opt out of and no consent banner, because nothing is stored on your device by these pages.
Infrastructure providers may set a short-lived cookie where one is technically required to deliver a page or to protect the Service from abuse.
We do not currently use cookies for third-party behavioral advertising. Because we do not sell personal information or use it for cross-context behavioral advertising, Global Privacy Control and similar signals do not currently change those practices.
12. How we disclose personal information
We may disclose personal information to:
- Vercel for website hosting, delivery, and infrastructure logs;
- Supabase for database, authentication, account, and synchronized-profile services;
- Resend for service and email delivery;
- Upstash for rate limiting and abuse prevention;
- an authentication provider you choose, such as Google, X, or GitHub;
- a payment provider if paid plans are introduced;
- professional advisers, auditors, insurers, and contractors who need the information and are bound to protect it;
- government authorities or other parties when required by law or reasonably necessary to protect rights, safety, security, or legal claims;
- a successor or transaction participant in a merger, financing, reorganization, acquisition, bankruptcy, or sale of assets, subject to appropriate safeguards.
We do not sell or rent personal information. We do not disclose personal information for cross-context behavioral advertising.
Service providers may process information only for the services they provide to GUTCALL, subject to their agreements and applicable law.
13. Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, considering the nature and sensitivity of the information, the relationship, source restrictions, security needs, legal obligations, and potential claims.
In general:
- pending Request Access submissions are retained while under consideration;
- declined, withdrawn, inactive, and legacy launch-interest submissions are retained for a limited period for communication, review integrity, duplicate-request management, and abuse prevention, then deleted or de-identified unless a longer period is required;
- approved application information may become part of the client or account relationship and be retained while that relationship remains active;
- account profiles, synchronized preferences, watchlists, and followed public identifiers are retained while the account is active and for a limited wind-down period after closure;
- local-storage information remains on your device until you clear it or the application removes it;
- security, access, and rate-limit records are retained for a limited period appropriate to security and incident investigation;
- legal acceptance, contract, billing, tax, dispute, source-rights, and compliance records may be kept longer where reasonably necessary or legally required;
- intelligence evidence and publication records may be retained according to source rights, evidentiary integrity, correction, safety, and legal requirements.
You may request deletion as described below. We may retain limited information to document the request, prevent re-creation, protect security, or satisfy legal obligations.
14. Security
We use administrative, technical, and organizational measures designed to protect personal information. Measures include authentication, access controls, row-level database security, entitlement checks, rate limiting, secret management, and vendor controls.
No system is completely secure. We cannot guarantee that unauthorized access, loss, misuse, or alteration will never occur. Protect your account, password, email, authentication provider, API credentials, and devices, and notify intelligence@gutcall.net promptly if you suspect a security problem.
15. Your rights and choices
Depending on where you live, you may have the right to:
- know whether we process your personal information and obtain access to it;
- correct inaccurate personal information;
- request deletion;
- obtain a portable copy of certain information;
- object to or restrict certain processing;
- withdraw consent where processing relies on consent;
- opt out of marketing communications;
- appeal a denied privacy request where applicable;
- not receive unlawful discriminatory treatment for exercising a privacy right.
Submit a request to intelligence@gutcall.net. Describe your request and the email, handle, account, application, public identifier, or other information needed to locate the relevant records. We may verify your identity and authority before acting. Authorized agents may submit requests where applicable, subject to verification.
These rights are subject to legal exceptions, including protection of another person's rights, security, fraud prevention, free expression, research, source confidentiality, trade secrets, legal obligations, and legal claims.
You may lodge a complaint with your local privacy regulator where that right applies.
16. Legal bases for EEA and UK processing
Where the GDPR or UK GDPR applies, GUTCALL relies on one or more of the following legal bases:
- steps requested before entering a contract, including reviewing an access request;
- performance of a contract, including providing an approved account or subscription;
- legitimate interests in operating, securing, improving, and protecting the Service; reviewing access; conducting and publishing lawful intelligence; preventing abuse; and managing legal claims, balanced against individual rights;
- consent, where we specifically request it;
- compliance with legal obligations.
GUTCALL operates from the United States. Personal information may be processed in the United States and other countries where our providers operate. If applicable law requires a recognized transfer mechanism or other safeguard for a covered transfer from the EEA, UK, or Switzerland, GUTCALL will implement it before making that transfer.
If GUTCALL intentionally expands its offering to people in jurisdictions requiring a local representative or additional disclosures, we will implement those requirements before doing so.
17. Children
The Service is not directed to anyone under 18. We do not knowingly approve accounts for or collect Request Access submissions from children. If you believe a child submitted personal information, contact intelligence@gutcall.net so we can investigate and delete it where appropriate.
18. Changes to this Policy
We may update this Policy as the Service, vendors, data practices, or law changes. We will post the revised Policy with a new date and provide additional notice where required.
If a material change requires consent or renewed acknowledgement, we will obtain it before applying the new practice where required.
